1. Acceptance of these Terms

By creating an account or otherwise using DesignadAI ("we", "us", "our"), you agree to these Terms & Conditions. If you don't agree, please don't use the service.

2. Eligibility

You must be legally able to enter into a binding contract to use DesignadAI, and you're using it on behalf of a real business you're authorized to represent (yourself, if you're a sole proprietor).

3. Your Account

You can create an account with an email and password, or by signing in with Google. Email/password accounts must verify their email address before generating any campaign — this is a security measure to confirm you own the address you signed up with, not an assessment of who you are.

You're responsible for keeping your account credentials secure and for all activity that happens under your account.

4. What DesignadAI Does

DesignadAI is an AI-powered tool that generates a marketing campaign — strategy, written copy, and a visual creative — from the business and campaign details you provide (your product or service, objective, target audience, offer, location, and the platforms you're marketing on).

You can regenerate a design, create a variation, or ask for natural-language edits to an existing design before downloading or using it.

5. AI-Generated Content

Campaign strategy and copy are generated using a third-party AI language model, and creative images are generated using a third-party AI image-generation model, based entirely on the information you provide. 6. Your Responsibility for Submitted Information

You're responsible for the accuracy of the business and campaign information you submit — your offer, pricing, claims, and any business details. DesignadAI generates content based on what you tell it; it doesn't independently verify any of it.

7. Your Responsibility for Reviewing Generated Content

Nothing DesignadAI generates is published or sent anywhere on your behalf automatically. You are solely responsible for reviewing, editing, and approving any generated strategy, copy, or creative before you publish, print, or otherwise use it commercially.

8. Acceptable Use

You agree to use DesignadAI only for lawful purposes, and not to:

• Attempt to circumvent the free-campaign limit, payment gate, or rate limits by technical means
• Use the service to generate content that infringes a third party's intellectual property rights
• Use the service to impersonate another business, person, or brand
• Attempt to access another organization's account, campaigns, or designs
• Interfere with or disrupt the service, or attempt to reverse-engineer it

9. Prohibited Content

You agree not to use DesignadAI to generate content that is:

• Illegal, fraudulent, or deceptive (including false advertising claims)
• Defamatory, harassing, hateful, or discriminatory
• Sexually explicit, or exploitative of minors
• In violation of applicable advertising regulations for your industry (for example, regulated claims in health, finance, or similar sectors)

10. Intellectual Property — Our Platform

The DesignadAI platform itself — its software, branding, templates, and interface — is protected by applicable intellectual property law. These Terms don't grant you any rights to it beyond using the service as intended.

11. Your Content

You confirm that the business information, campaign details, and any assets (such as a logo) you submit are yours to use, or that you're otherwise authorized to submit them, and that doing so doesn't infringe a third party's rights. You grant us a limited license to use what you submit solely to generate and deliver your campaign.

12. Generated Content — Your Rights

Subject to full payment (where applicable) and these Terms, you may use the campaign strategy, copy, and creative generated for your business for your own marketing purposes. This doesn't override the rights of any third party whose material you separately introduced (for example, your own logo or brand imagery), and it doesn't make DesignadAI itself, its templates, or its underlying technology yours.

13. Third-Party Services

DesignadAI relies on third-party service providers to operate — including an AI language model provider for strategy/copy, an AI image-generation provider for creative images, Razorpay for payment processing, and an email provider for account verification. Your use of DesignadAI is also subject to the extent those providers' own terms apply to how they process your requests.

14. Pricing, Payments, and Creative Credits

Every new account gets one free AI creative — a full campaign (strategy, copy, and one downloadable creative) with no payment required. After that, generating a further design, regenerating a design, or creating a variation each consumes one creative credit (editing an existing design with natural-language instructions does not).

Additional creative credits are purchased in packages shown on our Pricing page, priced in Indian Rupees (INR). The price and credit count for each package are fixed on our servers, not on anything sent by your browser — the price shown at checkout is the price you pay. As implemented today, purchased credits do not expire.

15. Free Campaign

The free creative is limited to one per verified account. It is not available again by creating a new account for the same business, and we may take reasonable steps to prevent abuse of the free tier.

16. Order and Payment Processing

Payments are processed by Razorpay. DesignadAI never receives or stores your card, UPI, or bank details — only the order amount, Razorpay's own order/payment reference IDs, and the payment status. A payment is confirmed once Razorpay reports it as captured, which we verify on our servers (either when you return from checkout, or independently via Razorpay's server-to-server webhook, whichever happens first).

If a specific generation attempt fails because of a system or provider issue, the credit (or free-campaign use) that was spent on it is automatically returned to your balance so you can use it again — see our Refund & Cancellation Policy for full detail.

17. Account Suspension and Termination

We may suspend or terminate your account if you violate these Terms, misuse the service, or attempt to abuse the free-campaign or payment system. You may stop using the service at any time.

18. Service Availability

We aim to keep DesignadAI available and responsive, but we don't guarantee uninterrupted access. The service depends on third-party AI, payment, and infrastructure providers, and may be temporarily unavailable or degraded due to issues with any of them, or with our own systems.

19. Disclaimers

DesignadAI is provided "as is" and "as available." We don't guarantee that AI-generated content will be error-free, unique, compliant with every platform's advertising policy, or suitable for every business or jurisdiction. See our AI-Generated Content Disclaimer for detail.

20. Limitation of Liability

To the fullest extent permitted by law, DesignadAI and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the service, including from content you generated, edited, or published using it. Our total liability for any claim relating to the service is limited to the amount you actually paid us in the preceding 3 months.

21. Indemnity

You agree to indemnify and hold DesignadAI harmless from claims, losses, or damages arising from your use of the service in violation of these Terms, or from content you submitted, generated, edited, or published using it.

22. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the date at the top of this page. Continuing to use DesignadAI after a change means you accept the updated Terms.

23. Governing Law

These Terms are governed by applicable law, without regard to conflict-of-law principles. Any dispute arising from these Terms will be handled in accordance with applicable law and, where necessary, before a court of competent jurisdiction. Nothing in this section limits any non-waivable consumer-protection rights available to you under the law of your place of residence.
